CCNNA as a member of the Cherry Creek Steering Committee (“CCSC”), along with other Cherry Creek Area Registered Neighborhood Organizations listed below, have entered into a
Development and Community Benefit Agreement regarding the Cherry Creek West development of the 13 acre parcel of property located at the corner of 1st Avenue and University (the “Property”).

The rezoning application of the Buell Foundation and East West Partners, as the developer, was approved by Denver City Council on September 23, 2024. By way of background, since 2021, the CCSC and representatives of CCNNA, Cherry Creek East Association, Country Club Historic Association and Hilltop Neighborhood Association (the “Area RNOs”) together with other surrounding residential members of the CCSC have met with the developer numerous times to discuss the rezoning of the Property for the proposed development project (the “Project”), the specifics of which are shown in the Project website at

The many developer neighborhood presentations resulted in substantial comments and concerns being raised regarding the Project, including questions regarding the amount of traffic that will be generated by the Project. The CCSC gathered these concerns and comments and outlined them to the Developer. Led by CCNNA, the CCSC then sought to address these concerns in a Development and Community Benefit Agreement and Declaration of Restrictive Covenants, which as signed and dated September 16, 2024 (the “DCBA”). The DCBA was negotiated over a period of 4 months following the delivery of the actual rezoning documents produced by the City. These rezoning documents did not include the specifics of the Project as the same had been presented to the neighborhoods and the DCBA was the only vehicle available to solidify the Project specifics and guarantee to the area residents that the Project would both include the benefits that the Developer had presented (such as open space and affordable housing) and restrict the Project to the overall height and limit the number of buildings. In addition, the issue of Project uses was negotiated to restrict medical office building uses that generate heavy traffic. Since the DCBA addressed many of these major neighborhood concerns and Developer commitments, the Area RNOs voted to fully support the Project. Each of the CCSC and the Area RNOs received their organizational approvals for the Project under the terms of the DCBA.
Below is an outline of the material terms of the DCBA (which includes links to the presentations on the CCNNA YouTube Channel) and a copy of the final DCBA, which will be recorded against the Property and will bind the Project development.
